Bicycle Helmet Laws?????????????

Are bicycle helmets required in the state of Florida.


Answer
The most universal "bicycle helmet law" is the law of physics!

Even if it is not required by law, wearing a helmet while biking is a dang good idea! Have you ever seen what happens to the human head when it hits the pavement at 30 MPH or more? How about when the human head hits a car with an impact speed of 60 MPH?

It ain't pretty!

If what's in your head isn't worth the price of a helmet in your opinion ... go without one! If you value what's in your head (your brain), wear a helmet.

We have 5 active children and they live in their bike helmets.... the rule in our house is "if it has wheels you had better be wearing a helmet". Bicycle helmets are required by Law here in NYS and it amazes me how many children come to my house without them. If they are at our home without a helmet they are not allowed on their bikes.

Is there a place I can contact for free bike helmets?? I would love nothing more than to make sure every kid in my town has one.... and wears it. Even though it is a law, it is not enforced, which kills me.

Contact some of your local bicycle clubs; I've seen some run fundraisers to donate helmets to kids.

But, sounds like these aren't "poor kids" but jsut that their parents don't enforce a helmet rule like you do. Why not just talk to Mom n Dad?

Or, you could go to any big discount store and find plenty of helmets under $20 each.

Answer
The LAW says minors (under 18 years old) MUST wear an approved helmet ONLY IF they are on a street or other public place. If youâre on private property, you can take whatever risks youâd like. The fine, if you get a ticket, is $25, and the FIRST charge can be dismissed.

Read the California Vehicle Code section 21212, regarding wearing bicycle helmets; violations and penalties:
(a) A person under 18 years of age shall not operate a bicycle, or ride upon a bicycle as a passenger, upon a street, bikeway, as defined in Section 890.4 of the Streets and Highways Code, or any other public bicycle path or trail unless that person is wearing a properly fitted and fastened bicycle helmet that meets the standards of the American National Standards Institute (ANSI Z 90.4 bicycle helmet standard), the Snell Memorial Foundation's Standard for Protective Headgear for Use in Bicycling, or the American Society for Testing Materials (ASTM F-1447 standard). This requirement also applies to a person who rides upon a bicycle while in a restraining seat that is attached to the bicycle or in a trailer towed by the bicycle.

(d) Any charge under this subdivision shall be dismissed when the person charged alleges in court, under oath, that the charge against the person is the first charge against that person under this subdivision, unless it is otherwise established in court that the charge is not the first charge against the person.

(e) Except as provided in subdivision (d), a violation of this section is an infraction punishable by a fine of not more than twenty-five dollars ($25). The parent or legal guardian having control or custody of an unemancipated minor whose conduct violates this section shall be jointly and severally liable with the minor for the amount of the fine imposed pursuant to this subdivision.

Why is it so hard to make wearing a bicycle helmet a law?

Seat belts are mandatory in all cars and its also illegal not to use it. Some states even require helmets on motor bikes. Why cant they make it a law to where a helmet when cycling. I've heard arguments like they cant tell you how to protect yourself because your life is your choice. Well its illegal to not wear a seat belt, its illegal to kill yourself, and its illegal to do many other dangerous things. According to those laws the government can decide the risks you take in life.
I am an avid cyclist and I always were a helmet. Its not uncomfortable and its not any real issue to have one. I have gotten in an accident before in which my head hit the ground. even with the helmet on I was still knocked out. This was also a very slow speed accident so any random kid could have the same thing happen and get killed because they didnt have a helmet.

Low-power cycle (LPC) is a generic term used by IIHS to cover motor-driven cycles, mopeds, scooters, and various other 2-wheeled cycles excluded from the motorcycle definition. While state laws vary, a cycle with an engine displacement of 50 cubic centimeters or less, brake horsepower of 2 or less, and top speeds of 30 mph or less typically is considered an LPC. Twenty-two states have motorcycle helmet laws that cover all low-power cycles. Twenty-five states and the District of Columbia have laws that cover some low-power cycles.

Twenty-one states and the District of Columbia have bicycle helmet laws that require some young bicyclists to wear a helmet. Local law may require helmet use for some or all bicyclists.

So soon all states will have this law......

Answer
Canada has some provincial and local helmet laws. Ontario's helmet law for cyclists under 18 took effect in 1995. It was originally to have covered all ages, and there is a bill in parliament now to extend it to do that. There is spirited opposition by a few cyclists there. (see links below) Proponents cite the cost of cyclists' injuries to the national health system, without reference to the much greater cost of treating those injured in cars, a blind spot also found in the US. In March, 2003, the Canadian Institute for Health Information announced that hospitalizations due to cycling-related injuries were down 12.5 per cent between 1997-98 and 2001-02.
The Canadian province of Nova Scotia enacted all-age bicycle helmet legislation in 1997. Toronto University Professor of Epidemiology Dr Mary Chipman published a research paper (PDF 44k) in March 2002 through the Canadian Medical Association Journal: "The data from Australia and now Nova Scotia suggest that legislation increases helmet use but also reduces the numbers of cyclists."

Further research published in the Canadian Medical Association Journal suggests a 62% reduction in cyclist numbers in Halifax the year after helmet law enactment, with more cyclist injuries recorded than before the law and a nominal reduction in head injuries (8 less head injuries in 1999).

The failure of the helmet law in the Canadian provinces of British Columbia and Ontario were also exposed in July 2003 by researcher Dorothy Robinson in a paper peer reviewed by pediatrics.com.

Is it necessary to wear a bike helmet when commuting to work?

In addition, I only ever ride my bicycle on the pavement/side walk shared by pedestrians; the only time I go on the road is when cross the lights for pedestrians.

Is it really necessary for commuters to wear a bike helmet. I just find it unnecessary to wear helmets on the street because the chances of collision and injury are a lot less than on the road, and I question the compulsory bike helmet laws.

If wearing helmets is mandatory, why don't we make the inclusion of airbags mandatory for all cars as well then?

Even when I ride on the sidewalk, which is illegal where I live, I have close calls when people are backing out of driveways and such. Not to mention the people that are getting out of their house I almost hit.

You're riding on the sidewalk and cross the street at a crosswalk, and a car makes a right turn, right into you. Cars aren't expecting bikes in the crosswalk, so you have to be very careful to avoid this one. This collision is so common we've lost track of the number of people who've told us they were hit this way, such as Ray John Ray. One study showed that sidewalk-riding was twice as dangerous as road riding, and another study said it's even more dangerous than that.

How to avoid this collision:

1. Get a headlight. If you're riding at night, you should absolutely use a front headlight. It's required by law, anyway.

2. Slow down. Slow down enough that you're able to completely stop if necessary.

3. Don't ride on the sidewalk in the first place. Crossing between sidewalks can be a fairly dangerous maneuver. If you do it on the left-hand side of the street, you risk getting slammed as per the diagram. If you do it on the right-hand side of the street, you risk getting slammed by a car behind you that's turning right. You also risk getting hit by cars pulling out of parking lots or driveways. These kinds of accidents are hard to avoid, which is a compelling reason to not ride on the sidewalk in the first place.

And another reason not to ride on the sidewalk is that you're threatening to pedestrians. Your bike is as threatening to a pedestrian as a car is threatening to you. Finally, riding on the sidewalk is illegal in some places. (In Austin, those places are the Drag, and downtown on 6th St. and on Congress). If you do plan on riding on sidewalks, do it slowly and EXTRA carefully, ESPECIALLY when crossing the street between two sidewalks."

While riding in the street is more intimidating, it places you in a position that makes you more visible to the motorist. the list goes on. Why cant liberals just let people die of their own stupidity and just let natural selection take place instead of making nanny state laws?
